Special Needs Planning in New Jersey and New York

Planning for your child’s long-term care and financial security.

If you’re a parent of a child with special needs, you’ve likely spent years making sure they have the care, support, and stability they need. Special needs planning extends that protection into the future, so your child continues to live comfortably and receive proper care even if you’re no longer able to oversee it yourself.

Why special needs planning matters

Leaving money directly to a child with disabilities can unintentionally disqualify them from important government programs such as Medicaid and Supplemental Security Income (SSI). Without a proper legal structure in place, well-intentioned gifts or inheritances could jeopardize their long-term care.

A carefully designed plan allows you to provide financial support while maintaining eligibility for these benefits. It also ensures a smooth transition of responsibility to trusted caregivers or trustees when you’re no longer able to serve as the decision-maker.

How we help families plan for the future

Creating Special Needs Trusts

Establish a legally recognized trust that holds assets for your child’s benefit without impacting their eligibility for government assistance.

Appointing Guardians and Trustees

Choose reliable individuals to manage funds, coordinate care, and make decisions on behalf of your child when you cannot.

Coordinating Benefits and Financial Resources

Structure inheritances, insurance, and accounts to work alongside public benefits, not against them.

Planning for Housing and Care

Ensure your child has appropriate living arrangements and the financial resources to support them long term.

Updating Plans Over Time

Adjust documents as laws change or as your child’s needs evolve, maintaining consistent protection.

Meet Joseph A. D’Urso III, An Experienced Special Needs Attorney

I grew up in Bergen County and built my practice to support families who need a steady hand with special needs planning. My work focuses on putting the right legal structure in place so a loved one keeps essential benefits and has dependable care for the long term. I regularly create and fund special needs trusts, coordinate Medicaid and SSI eligibility, prepare letters of intent for care and daily living, and help families select and prepare guardians, trustees, and successor decision-makers. I also advise on ABLE accounts, beneficiary designations, and housing or support arrangements so the financial and practical parts line up. Clients get clear explanations, precise documents, and a plan that can be updated as needs change. I serve families across New Jersey and New York, with a local focus on Bergen County and Rockland County.

Serving families throughout New Jersey and New York
